All bookings made through Ty Annie Ltd shall be subject to these Terms and Conditions. Please read carefully. Bookings for accommodation by guests (the Guest) are accepted by Ty Annie Ltd trading as Ty Annie Holidays (The Agent) on behalf of owners (Owner).
In these Terms and Conditions ‘You’ and ‘Your’ means all persons booked into the property (including anyone who is added or substituted to the booking at a later date). ‘We’, ‘Us’ and ‘Our’ means Ty Annie Ltd of Corner House, 22 High St, Cardigan, Ceredigion, SA43 1JG. Unless the context otherwise requires words in the singular shall include the plural and vice versa.
1. THE CONTRACT
The rental contract is between the Guest and the property Owner. Ty Annie Ltd acts as an Agent of the Owner. The contract has been made when the Guest pays their booking deposit. The Agent will send a booking email on deposit payment, delivery cannot be guaranteed. The Guest must be over 18 years old at the time of booking.
2. THE BOOKING
All parties included in the booking should be aware of and adhere to these terms and conditions. It is the responsibility of the Guest who made the booking to ensure that all parties are made aware of the contract details. The property Agent/Owner has the right to decline or refuse a booking and to decline entry to a property for any person who has not complied with these Terms and Conditions.
3. PAYMENTS
Non-refundable deposit
A non-refundable deposit of 30% of the total cost of the holiday is due on booking.
Balance payment
The balance is due to be paid 6 weeks before the start of your holiday start date. The total amount is payable if the booking is made less than 6 weeks before arrival.
If the balance payment is late, the booking may be cancelled and the deposit will be retained.
Refundable damage deposit
Some owners charge a refundable damage deposit. This deposit is retained until after your departure, and we reserve the right to withhold any amount to cover the costs of any damage at a property caused by you.
4. CANCELLATIONS
Cancellation or Changes by the Guest
A legally binding contract is formed when a Guest makes a booking. If the Guest cancels a booking for any reason including Covid-19 restrictions, weather, health etc, then no refund whatsoever will be due.
If the full balance has been paid and there is longer than 6 weeks until the holiday arrival date, all monies above the deposit amount will be refunded.
If the full balance has been paid, and the holiday start date is within 6 weeks, no refund whatsoever will be due.
Cancellation by Owners
The Agent/Owner reserves the right to refuse any booking and to cancel any bookings already made if the property is unavailable, subject to a full refund of all monies paid (but no further liability). Neither the agent nor the owner shall be under any other liability if such cancellation occurs. In the unlikely event of a cancellation, the agent will make every possible effort to secure alternative accommodation or move the booking to alternative dates if mutually accepted.
How to cancel your holiday
You must notify the Agent in writing to info@tyannie.co.uk to cancel your holiday before the holiday start date.
We advise that you take out suitable insurance to cover cancellation and emergency expenses.
5. PETS
Guests may only bring the number of pets they book in at the time of booking and pay any associated fees outlined in the booking breakdown.
Pets are not allowed upstairs, in any bedrooms or on soft furniture. Please clean up any mess after your dog, including in the grounds.
Pets should not be left unattended at a property at any time, for any reason.
If a property description states no pets, pets are not permitted, but it cannot be guaranteed that pets have not been at the property before.
It cannot be guaranteed that a garden is secure and it is the Guest’s responsibility to ensure dogs are kept under control, especially in rural areas.
6. OCCUPANCY
Number of People at the Holiday Let
The Owners allow the Guest and all other members of the party to occupy the property for holiday purposes only. Nobody else is permitted to use the property.
The maximum occupancy number must be respected, and the Guest must send us an email with the names of every person in the party along with their ages before arrival. On occasion, the Owner/Agent may agree to allow extra guests to stay, but this must be confirmed in writing. Extra charges may apply.
Changes in occupancy
Changes to occupancy need to be made to us in writing to info@tyannie.co.uk before the start of the holiday.
Children and babies
It is the Guest’s responsibility to ensure the safety of children and babies at all times
7. ARRIVAL AND DEPARTURE
Guests can check in any time after 4pm on the day of arrival. Check-out is by 10am. Please remember, especially during high season that cleaning teams are very busy and checking-out late can completely throw off their schedule. The Agent/Owner reserves the right to charge for late check-outs.
8. CLEANING
It is part of this agreement that a property is left in a similar state in which it was found (light cleaning accepted). If a property is left in an unacceptable state, we reserve the right to charge you for extra cleaning.
9. DAMAGE, LOSS, THEFT
Guests will inform the Owner/Agent of any damage at the property however caused. Guests should not remove any item from a property and the Owner reserves the right to charge for replacement costs.
10. NUISANCE
Guests should respect neighbours and surrounding people/properties. Quiet times at all properties are between 8pm and 8am.
If the Agent/Owner decides that a Guest is not suitable to continue the occupancy of a property because of bad behaviour, damage, nuisance the contract may be withdrawn without notice to the guest and the Agent/Owner may repossess the property immediately. The guest will remain liable for the whole cost of rental and no refund shall be due.
11. ACCESS
Guests must allow access to the property by the Agent/Owner for any reasonable reason.
12. COMPLAINTS
Please make complaints in writing to info@tyannie.co.uk. The Agent does not accept any responsibility for any changes made by Owners at the property, or for the failure of an Owner to keep the property in good condition including but not limited to clean, safe and dry.
The Agent cannot be held responsible for any errors or inaccuracies in photographs on property descriptions authorised by the Owner. Property descriptions and all details both written and verbal are given in good faith and believed to be correct, but interpretation thereof can be subjective and as such their accuracy cannot be guaranteed.
13. DISPUTES
All disputes arising from a booking will be between the Guest and Owner. The Agent will not be liable for any claims from either party. Accidents howsoever caused during the holiday are not the liability of the Agent. The responsibility for the upkeep of the property and any relevant Health and Safety considerations lie with the Owner. Complaints received after departure are not accepted.
14. LIABILITY
The Agent does not accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property, its plumbing, gas, electrical services or exceptional weather No responsibility is accepted for loss or damage of property. The maximum liability accepted by the agent/owner will be the total cost of the holiday as paid by the guest to the agent. No other expenses such as travelling costs or alternative accommodation will be accepted.
15. NO SMOKING
There is a no smoking policy at every property advertised with Ty Annie Holidays
16. WAIVER
The failure of the owner to enforce or exercise, at any time or for any period of time, any term of, or any right pursuant to this agreement does not constitute and shall not be construed as a waiver of such term or right.
17. FORCE MAJEURE
The Owner/Agent cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside our control.
